The administration of Trade, Business & Fictitious Names (“DBA”) registrations in Delaware will be transitioning as of February 2nd , 2026. DBA Registrations will now be done through Division of Revenue through an online process and will apply statewide.  

Applicants will need to provide the legal name and address of the entity, the proposed trade name, names and addresses of ownership, date of formation, and nature of business. Any LLCs or Corporations that are not actively transacting business in Delaware will be required to provide a Certificate of Good Standing from the Delaware Division of Corporations and additional documentation, where applicable. There will no longer be a requirement to notarize the registration document. 

Entities that are not conducting business in Delaware will be able to register for a Trade Name Only business license. Holders of this license will not be required to file Gross Receipts and Business Income Tax Filings. All other fees and maintenance will remain the same. 

For existing DBA holders, they will have to re-register through the new system during the transition period.  

In the interim, DBA registrations will continue to be processed under the existing system through the Prothonotary’s Office in the relevant county.
